NOTICE TO ALL CUSTOMERS
PNG CONTAINER DEMURRAGE AND DETENTION POLICY


 ANL & CMA CGM advises all its PNG Customers of the Detention and demurrage terms, conditions and surcharge structure effective from 1st January 2017 are as stated.


 Please note the below definitions, terms and conditions of use are applicable for all ANL and CMA-CGM containers and equipment in PNG.


 For further information please contact the Logistics Department at ANL Agencies in Lae or Port Moresby.


The below mentioned definitions, calculation methods and terms and conditions apply to all ANL & CMA CGM services to and from Papua New Guinean ports.[br /]  Demurrage and Detention do not include storage costs and charges for reefer services which are charged to the Merchant separately. Demurrage and Detention are Shipping Line charges and Storage charges are a Port or terminal/Wharf charge.


STORAGE, DEMURRAGE AND DETENTION: DEFINITIONS AND CALCULATION

• Detention – Detention is the charge levied by the Line for use of the Lines container (outside the terminal/port) after exceeding the (detention) free time period.


• Demurrage – Detention is the charge levied by the Line for use of the Lines container (inside the terminal/port) after exceeding the (demurrage) free time period.


• Merged Detention and demurrage – are a combination of both the above definitions and charges less the combined free time period granted in days


• Import cargo detention, the detention time is the duration calculated (number of days less free days granted) from gate-out of the full container till gate-in of the empty container into the assigned ANL terminal or depot.

• Export cargo detention, the detention time is the duration in days (less free days granted) from the pick-up of the empty container (from the ANL terminal or depot) till gate-in of the full container in the assigned terminal. https://ecommerce-cms.cma-cgm.com/ANL/news/Pictures/PNG%202.jpg


• Terminal Storage is charged from the first day after expiry of import free time. The consignee / receiver agrees to pay applicable storage charges to the terminal operator (PNG Ports) at whose terminal the container is stored beyond the free time storage period. All applicable storage charges are payable to PNG Ports direct.


• Reefer Services: these services such as electricity supply and monitoring charges which are on account the consignee or shipper

CONTAINER BONDS


Container Bonds are applicable in the following circumstances


• Class A for Container(s) for which the Delivery Order was not issued within 30 Days of the cargo arrival.


• Class B Insufficient or unconfirmed consignee address details


• Class B Cargo moving to coastal outports or inland locations


• Class B Customers with long idle boxes & detention owing


Container bonds to be refunded within 7 Days of the empty container return confirmation less any costs (including but not limited to damage, detention, loss and storage charges).

IMPORT AND EXPORT DEMURRAGE AND DETENTION LIABILITY


• If containers are not returned to the wharf or nominated container terminal within the free time period, the consignee (for import containers) or shipper (for export containers) will be responsible for all payment of demurrage and detention charges.


• The Import Consignee is responsible for any charges incurred whilst in their agent’s or third party’s (i.e. Transport Company, Customs Agent) custody.


• The Shipper is responsible for any charges incurred whilst in their agent’s or third party’s (i.e. Transport Company, Customs Agent) custody.


• As per the terms and conditions of carriage as stipulated on the back of the Bill of Lading / Delivery order; there is no “contract” between your transport company and the Shipping Line/Company. Liability for detention cannot be transferred to a third party.


• At the end of each month a statement and invoices will be sent to you outlining any outstanding detention charges. This statement must be settled within fifteen (15) days of receipt.


• ANL Agencies, or its nominated agent, reserves the right to take any necessary and appropriate action for the recovery of outstanding charges and equipment (containers).


PAYMENT TERMS


Queries on Demurrage and Detention Invoices


• Any queries relating to container demurrage and detention charges (both import and export) must be raised in writing by the consignee/shipper within 7 calendar days of invoicing.


Payment of Outstanding Demurrage and Detention Charges


• Effective from 1st January 2017 All agreed container detention charges must be paid within 15 calendar days of the invoice issue date. Payment can be made directly to the ANL PNG offices in Port Moresby or Lae.
